Irwin Mitchell has recently handled a case whereby a woman claimed over £2,000 in compensation, after she tripped over a broken, dangling telephone wire on a street in the Leeds area.
A claim was made against BT and the local authority, as it was found that concerns about damage to the telephone lines had been reported to BT but no repairs were made. An occupier of nearby premises had reported a fault with their line which was due to trees being cut down at the adjacent property, causing the telephone lines to dangle down to the ground below.
Another line was also damaged and not repaired, and this was the line that dangled down to pavement level, causing our client to trip over. The fall caused injury to her left shoulder and a sprain to her right foot. Medical evidence in the case found that the accident was responsible for six months of shoulder pain and shock.
Irwin Mitchell was able to secure £2,200 in compensation for our client, along with payment of her legal costs, in an out-of-court settlement.
