Court of Protection Deputyships

There are many reasons why a person in your life may no longer be able to manage their own financial affairs or make informed decisions about their personal welfare.

 

Degenerative, physical and mental illnesses are just a few common factors. In cases like this, it is often necessary to appoint a Deputy to be responsible for the vulnerable person's decisions about issues like healthcare, property and finance.

You can act as a deputy for someone who’s no longer able to make their own decisions, or manage their own affairs.

As a deputy, you might need to:

  • Manage the sale of a property
  • Make decisions about their contact with others
  • Apply for a statutory will if the person can’t make one themselves
  • Manage their finances (accessing benefits, managing trusts, completing tax returns, etc.)
  • Make decisions about the person’s living arrangements, care, or medical treatment, and how it’s paid for.

Deputies will also need to submit annual reports to the Office of the Public Guardian.

In some cases, you may need to apply to the Court of Protection to allow you to make an important decision.
