What Is Leasehold Enfranchisement?

If you own a leasehold property, you may have the right to extend your lease or even buy the freehold of the property from your landlord. This is known as Leasehold Enfranchisement.

You only own a leasehold property for a fixed period of time. A landlord has permanent ownership of the property, or 'freehold'. A lease is a legal agreement between you and the landlord that states how long your leasehold ownership will last.

If you want to continue owning a leasehold property beyond the end of your current lease, you can either ask your landlord to extend the lease or sell you the freehold for your property so you own it permanently yourself. If you live in a flat you will need to buy a share of the freehold for the whole building. You must meet certain criteria in order to qualify for this.

What Is Probate?

Probate is the legal process for managing a deceased person's estate. This includes specific requirements for selling or transferring ownership of the deceased's property, such as:

  • Selling a property requires evidence of your right to sell with a Grant of Probate
  • Sales also require additional clauses in the transfer contract to protect the personal representative or executor of the Will
