A manufacturer with 80 staff and a £16m annual turnover contacted us for advice on how to handle a disciplinary issue with their top salesman.
The salesman had been given a 15 month dangerous driving ban that would have impacted his ability to get to and from appointments. On our advice, the company followed a disciplinary procedure which led to them dismissing the salesman.
During the process, they discovered that he had been sending sensitive commercial data to a personal email address. We advised that they should examine his emails, which revealed that their HR manager had also leaked similar data to the salesman during his suspension.
The company threatened disciplinary proceedings against the HR manager as well, and they left under a settlement agreement.
