Restructuring & Insolvency

Our restructuring and insolvency lawyers work for lenders, insolvency practitioners, businesses and directors.

We can help businesses restructure without the need for a formal insolvency. But if that’s not possible, we can advise on all aspects of both personal and corporate insolvency procedures.

What Restructuring & Insolvency Services Do We Offer?

Our restructuring and insolvency lawyers can support you with matters involving:

  • Business turnaround
  • Restructuring
  • Insolvency
  • Company Voluntary Arrangements (CVAs)
  • Receivership
  • Liquidation
  • Commercial recoveries

We also offer corporate advisory services if your business is in financial distress (or where distress is anticipated).

Who Can We Help?

  • Lenders
We are on the legal panels of most of the major retail banks in the UK, as well as independent asset based lenders. We have particular expertise in managing volume LPA receiverships.
  • Insolvency practitioners and restructuring professionals
We help practitioners with the appointment of insolvency office holders, sale of assets, dispute resolution and the discharge of their duties (both for corporate and personal insolvency matters).
  • Businesses and stakeholders
Our lawyers work with businesses of all sizes – from owner managed businesses through to large corporates. We can also advise shareholders, pension schemes and other creditors of a financially distressed business.
  • Directors
We can advise you on the necessary legal and regulatory requirements if your business is insolvent or in financial distress. Our team can also act for you personally, if you’re facing litigation or disqualification following the failure of a company.

Why Choose Our Restructuring & Insolvency Lawyers?

Our team works for businesses in financial distress, as well as creditors looking to recover their money. We can also help you identify and manage risk, to prevent potential situations of financial distress.

We’re on the panel of most major retail banks in the UK, and have relationships with insolvency practitioners throughout the country. Due to the size of our team we can provide urgent advice and manage large scale and international transactions.

As a full service law firm, we can draw on the specialist experience of other lawyers in areas including employment, pensions, real estate and litigation.

We understand that with financial pressure, you may have concerns about how to pay legal fees. We offer alternative funding arrangements in these situations, including conditional fee agreements.

Case Study – Houst Limited

Houst employs 300 people through independent contractors across eight countries. The Company and its Group specialises in providing property management services for short-term and holiday lettings. Houst lists properties on websites such as Airbnb and booking.com. However, the coronavirus pandemic resulted in a significant reduction in demand.

Our solicitors liaised with the High Court on Houst Limited's behalf in July 2022. We proposed the High Court should sanction the Restructuring Plan for Houst Limited (the “Company”) and its subsidiaries (the “Group”).

This landmark decision was the first SME Restructuring Plan. This helped to cement the process as a feasible tool for SME businesses and large corporates. This was the first time a Restructuring Plan procedure included the cross-class cram down of the UK tax authority, HM Revenue & Customs, the dissenting secondary preferential creditor in this case.
