Our Scottish personal injury claims team settled a road traffic collision case for a five-figure sum. Vidisha Goyal sustained partial loss of sight, and her family were left with physical and emotional injuries in the collision.
What happened to Vidisha?
Vidisha was travelling with her family by car to Inverness along the A22. She was asleep in the back of the car. The family were on holiday at the time when they were struck by a car travelling in the opposite direction, being driven by a foreign national.
The car crashed into the rear seat on the passenger side of Vidisha’s car. The collision caused her significant injuries, particularly restricted vision in her left eye. There was a degree of contributory negligence due to Vidisha not wearing a seatbelt at the time of the collision
How has this impacted Vidisha and her family?
Vidisha and her family experienced both physical and emotional distress as a result of the crash.
Having to break the news of the accident and injuries to the rest of her family also caused Vidisha distress.
How did Irwin Mitchell’s Scottish personal injury team help?
Our road traffic accident claims solicitors investigated Vidisha’s case. They instructed independent medical experts to write reports on her maxillofacial, jaw, and ophthalmologic and psychological injuries.
We concluded contributory negligence of 25%, There was a degree of contributory negligence due to Vidisha not wearing a seatbelt at the time of the collision.
The driver of the other car admitted liability and was cooperative throughout the claim. David Bell, a senior associate solicitor for Irwin Mitchell Scotland LLP, handled Vidisha’s claim. He was able to get a net five-figure compensation settlement for Vidisha.

Client quote
“I would say Irwin Mitchell and the team was really pleasant. They were on top of everything, and I never had to go after them. There was constant communication, and I was kept in the loop of everything going on. I was updated constantly. There had been delays on my end when getting back to David, but he was really mindful and on top of it.
“Once everything was out there, it didn’t take much time to get it sorted. I was really impressed. I am a student from India and, in situations like this, you don’t become accustom the way it is back in India, and I thought the way it was handled was beautiful and seamless.” – Vidisha Goyal, client.
