Our medical negligence solicitors secured £18,000 in compensation on behalf of our client, Miranda*. This was after a delayed diagnosis of non-curative cancer.
What happened to Miranda?
Miranda contacted our medical negligence team because she’d experienced a delayed diagnosis of metastatic renal cell carcinoma – a very rare, aggressive, and non-curative cancer.
She had concerns about how long it had taken to be diagnosed, as she’d attended the hospital numerous times with different symptoms. These symptoms included blood in her urine and pain in her right flank and abdomen. She was finally diagnosed 2.5 years after first going to hospital.
Tragically, Miranda passed away while her claim was ongoing, but her brother continued to pursue her claim on her behalf.
How did Irwin Mitchell’s medical negligence solicitors help?
Our medical negligence solicitors began investigation by requesting a full copy of Miranda’s medical records. We contacted independent medical experts and obtained reports from them on the treatment Miranda received.
We’d tried to settle Miranda’s claim while she was still alive, but the NHS Foundation Trust responsible weren’t willing to settle.
We instructed another expert to investigate Miranda’s care. This expert highlighted extra allegations of medical negligence, but the Trust still denied liability. However, they agreed to enter negotiations.
An £18,000 settlement
We were able to settle Miranda’s claim before needing to issue court proceedings. While the Trust still refused to admit liability, we managed to secure £18,000 in compensation through negotiation.
This money will help to compensate Miranda’s family for her passing, including her pain and suffering and funeral expenses.
Miranda’s family want to continue to raise awareness of this rare form of cancer, including the symptoms and the importance of getting them checked. They also wish to highlight the need to push for further investigation if you feel that you are not being listened to.
Expert comment
Daniella Gregory, a medical negligence solicitor, handled Miranda’s claim. Speaking of this case, Daniella said: “Although Miranda’s cancer couldn’t have been cured, an earlier diagnosis could have resulted in more aggressive treatment. This meant she would have had a longer life and would have given her more time with her family. Those precious extra months would have been invaluable to her loved ones.
“Although nothing could have saved Miranda in the long term, her family had to endure the heartbreak of a premature goodbye. No amount of money can make this right, but being able to provide some help and relief to her family brings a sense of comfort in such a painful time. This money helped to relieve the financial strains of giving Miranda the sendoff she deserved.”
