Mr X was arrested for a very serious allegation in Sept 2009 by Sussex Police.
He was kept in custody for several hours and was released without charge after his fingerprints, photo and DNA were obtained.
He was released after it transpired they had arrested the wrong man but with the same name.
A claim for unlawful arrest was made and Sussex Police conceded liability. The police said that more should have been done to differentiate between the two persons sharing the same name.
Sussex police have paid damages and legal costs. They have also agreed to destroy Mr X's fingerprints, photo and DNA from their database.
The case was concluded in March 2011.
