Tier 2 & 5 Sponsor Licence

Tier 2 Sponsor Licence Revoked

The Home Office could revoke your Tier 2 sponsor licence if you don’t comply with immigration law. Our lawyers can challenge the decision or help you work through any non-compliance issues so you can avoid penalties and protect your business.

It can be difficult to manage your Tier 2 sponsorship duties but having a sponsor licence revoked or suspended could have serious consequences for your business and employees. You may face heavy fines and all your non-EEA employees may have to leave the UK.

Contact our immigration team on 0808 271 2602 if your licence was revoked or if you need advice on complying with your sponsor duties.

Frequently Asked Questions

Why Could My Sponsor Licence Be Revoked Or Suspended?

Your Tier 2 sponsor licence could be revoked or suspended if you:

  • Give false information to the Home Office (such as on your licence application)
  • Don’t provide information that the Home Office asks for
  • Fail to comply with your sponsorship duties
  • Are issued with a civil penalty for employing one or more illegal workers
  • Employ a non-EEA worker who doesn’t meet the skill level requirements for that role.

Contact us on 0808 271 2602 if your licence was revoked and you’re unsure on the next steps.

What Will Happen If My Sponsor Licence Is Revoked?

Having your licence revoked or suspended will affect your business and all your non-EEA employees who you’ve sponsored to work in the UK.

If you’ve employed illegal workers, you could face fines of up to £20,000 per illegal employee.

If the Home Office revokes your license, any employees you’ve sponsored and who were involved in the decision will have to leave the UK immediately. Employees not involved will have 60 days to leave the UK.

Failing in your sponsorship duties could lead the Home Office to investigate your business and you may have to pay a fine. The amount of the fine will depend on how seriously you went against sponsorship regulations.

We can advise if you believe your licence was revoked unfairly or by mistake, and help you challenge the decision. Our team can also help you reapply for a licence after the 12 month cooling-off period has passed.

Will Brexit Affect Tier 2 Sponsor Licence Regulations?

The Home Office hasn’t said how Tier 2 sponsor licences will work after Brexit. We’re advising all our clients to keep up-to-date on immigration law and sponsor licence regulations.

After the UK leaves the EU, businesses could face a situation where they’ll need to sponsor EU workers in the same way they sponsor non-EEA workers. Having a history of immigration compliance will show the Home Office you’re a reliable sponsor making future applications easier.

Contact our immigration team on (0)370 1500 1000808 271 2602 if you have any Brexit-related concerns. The sooner we can try to prepare for these issues the better.
