Irwin Mitchell’s serious injury solicitors helped secure a substantial settlement for a young man, who suffered significant injuries, including a severe brain injury, in a collision with an ambulance responder vehicle.
Accident
Our client was in the process of making a right hand turn into a major road when the accident occurred. The junction had many cars on both sides of the road severely limiting our client’s view of approaching traffic. As our client proceeded out of the junction he was hit by an ambulance first responder vehicle. The accident happened at lunch time in a built up area in close vicinity to schools and colleges. The ambulance responder vehicle was responding to a 999 call and was travelling well above the speed limit and far too fast for the circumstances of the road at that time.
Liability
Our client contacted Carolyn Heaton in our Serious Injury team. The ambulance service denied liability for a long time resulting in court proceedings having to be issued against the driver of the first responder vehicle and the ambulance service.
After a long and hard-fought battle, liability was resolved on a 50/50 basis, meaning that our client would receive 50% of the compensation due to him for his injuries.
Ongoing difficulties
Due to the severity of his injuries, our client was left with a range of on-going difficulties, including problems with:
Memory, planning and organisation
Problem solving
Irritability and verbal aggression
Our client was able to return to his pre accident work but was very much protected by his line manager who made various allowances for him in order to accommodate his difficulties. Our client and his family were concerned that when his line manager retired, our client would struggle to keep his job or get a similar job in the future.
Settlement
Our Serious Injury team recently settled our client’s claim and he will now receive a substantial six-figure settlement which includes a large sum for any future loss of earnings he may incur together with money to pay for the support he may need when he leaves the family home.
Our client has since sought professional advice from Irwin Mitchell’s Asset Management team who will now assist our client in carefully investing the money to ensure that he has sufficient funds to pay for all of his needs for the rest of his life.
Carolyn Heaton represented our client and said: “Thankfully with the help of his extremely supportive family, our client made a very good recovery but unfortunately was left with a range of subtle problems which actually had a very big impact upon his life.
“Having the appropriate experience to fully understand issues arising from brain injury allowed us to make sure our client was properly compensated.”
