Our medical negligence team secured compensation for our client, Stephen*, who was seriously injured after a hospital failed to safeguard him.
What happened to Stephen?
While Stephen was a patient, and disorientated following a seizure, he was able to access an open window fell to the ground below. He sustained a subarachnoid haemorrhage with intracerebral bleed (a stroke caused by bleeding in the space between the brain and surrounding tissue) and multiple skull fractures. He also sustained fractures to his jaw, right femur, ribs, and vertebrae.
Stephen’s ability to access the window was made possible because he hadn’t been safeguarded appropriately.
How did Irwin Mitchell’s medical negligence lawyers help?
Due to his injuries, Stephen’s wife contacted our medical negligence team as he was unable to bring his own claim.
Our team instructed independent medical experts to review the situation and comment on who was liable for Stephen’s injuries. They concluded that inadequate safeguarding had amounted to medical negligence, making it easier for Stephen to injure himself.
The hospital admitted liability after we submitted a Letter of Claim. Trial was listed for 2026, but we were able to reach a settlement before it was necessary.
A six-figure settlement
We were able to settle Stephen’s claim for a six-figure compensation sum. This money will help him to move on with his life, by funding the right support to let him live his life to the fullest.
Stephen’s compensation will help to pa\y for care, accommodation, and equipment.
Expert comment
Stephen’s claim was handled by Lauren Hurney, a partner in the medical negligence team. Commenting on Stephen’s case, she said: “Stephen was a vulnerable person left who was neglected by those who should have been providing him with an adequate level of care and supervision. As a result of their failure to do so, he sustained serious injuries that will impact the rest of his life.
“While no amount of money can undo the injuries Stephen sustained, I’m so glad we were able to successfully settle for such a large amount. This will help to make sure he’s supported for the rest of his life.”
