Road traffic accident solicitors at Irwin Mitchell secured compensation for a woman who suffered a traumatic brain injury after being struck by a lorry.
Our client was in London on the way to an exhibition with her partner when the lorry hit her. The nearest pedestrian crossing was completely blocked by vehicles, so they had attempted to cross the road to the left of this crossing where there was a big enough gap in the congested, unmoving traffic. She was almost across the road when a previously stationary lorry suddenly began to roll forward. Her partner tried to pull her out of the way but the lorry struck her shoulder, knocking our client to the ground where she banged her head.
A pedestrian dialled 999 and our client was soon rushed to hospital where scans revealed a bleed to the brain and a small fracture to the skull. She was treated by medical staff before being sent home just over a week later.
On the second day in hospital our client noticed that food and drink didn't taste of anything at all and that she wasn’t able to smell anything. During all of her grown-up life she has been fond of cooking, trying new tastes and spices from different kitchens. Now, without the ability to taste, a significant part of her life has gone missing. Without her sense of smell she is also unable to be warned by smells indicating danger (such as burning, different gases and bad food).
Our client also now suffers from problems with her balance and has had a number of falls at home and out shopping. Her vestibular problems include vertigo, dizziness and disequilibrium, in addition to cognitive issues like a lack of concentration and reduced reading speed. As a result of these problems, life has become more complicated for her, with more effort needed to stay independent.
Solicitor Laura Murphy, based in our London office, helped our client win compensation for her injuries. Laura said: “This was a strongly contested case on liability – it was very satisfying to bring to a conclusion and secure compensation for our client when her independence and enjoyment of her retirement has been affected as a result of the accident.”
