Our client worked in a factory and as part of his job had to manually push a heavy wheeled trolley along some tracks. One day while pushing the trolley it came to a sudden halt while he was pushing it due to debris that had built up in the tracks. Our client sustained a jarring injury / sprain to his back.
As a result of his injuries our client was off work for three months and had to return for a few months on light duties. Our client settled his work accident claim out of court with a £5,000 compensation settlement after the defendant admitted liability.
Lisa Fairclough was the solicitor involved in this case. She said: "The case serves to illustrate the importance of assessing all manual handling tasks and also ensuring that rubbish is not allowed to build up in the workplace. Had our client's employers made a proper assessment of the job in hand then they would no doubt have noted the potential hazards and measures could have been taken place to avoid an accident."
