Irwin Mitchell's specialised personal injury team has helped a 19 year old man claim compensation after he was struck by a car while he was walking home from a music festival.
The man was walking home on a country lane with a group of friends in Matlock, Derbyshire when the accident took place. The defendant was driving along the unlit road and didn't see the group of friends until he had hit them. He was later prosecuted for driving without due care and attention.
Following the accident the our client was taken to hospital where he was diagnosed with a fracture to his leg which later required surgery.
The man decided to contact Irwin Mitchell’s specialised personal injury team and one of our experienced solicitors, Nicola Meese, was able to deal with his claim. After some negotiations we were able to secure compensation for our client.
The defendant had argued that he was not entirely to blame for the accident. He claimed that our client and his friends were walking on the wrong side of the road, putting themselves in a dangerous position.
While these allegations made by the defendant were not accepted by our client, he did not wish to argue them in court and so accepted a lower amount of compensation in order to bring his claim to a conclusion.
