Our client was exposed to asbestos dust while working for Norwest Holst PLC. One of his duties was to undertake soil investigations of areas around potential construction sites, including the former J.W. Roberts factory in Leeds. Additionally, he was exposed to asbestos dust whilst carrying out other test drilling activities on asbestos contaminated sites. The claim alleged that Norwest Holst PLC had negligently breached many of the statutory duties owed to him.
Our client was diagnosed with mesothelioma in July 2010 and was told by medical experts that he had 18-24 months left to live. It is certain that the disease will progress, causing him to experience further chest pain and breathlessness which is likely to become severe, restricting his mobility and causing him to experience severe pain.
Whilst no level of compensation can be adequate given that our client has been diagnosed with a terminal illness, it nevertheless vindicates his decision to pursue legal action leading to a position where Norwest Holst PLC eventually acknowledged their responsibility for causing our client’s terminal disease.

Whilst I am pleased that a successful conclusion was eventually reached, it is disappointing that Norwest Holst PLC did not accept responsibility sooner in the face of convincing evidence and that their insurers fought so hard to avoid payment of any compensation at all.”
