Irwin Mitchell's specialist personal injury team has helped a gardener to obtain compensation after he suffered a back injury whilst at work.
Our client worked as a gardener; the accident occurred whilst he was returning tools to a shipping container which was outside in the yard.
The weather was freezing cold and the ground was icy and snowy. The container doors were locked with a padlock which was frozen and was particularly stiff and as a result, our client had to use more force in attempting to unlock the padlock than usual and in doing so, felt a sudden spasm of pain in his low back. He then pulled the handle of the padlock again and as he did so, he slipped on the ice and fell to the ground landing on his bottom. He felt an instant increase in pain in his low back radiating into both buttocks.
He went to his GP’s surgery and was referred for physiotherapy.
Our client continued to suffer with a persistent low back pain and was referred for an x-ray at the Kingsmill Hospital. He was subsequently referred for further physiotherapy. Our client has since undergone MRI scanning and further x-rays and has also undergone pain management treatment.
Following the accident our client had to have four weeks off work and on returning to work was initially on light duties but was gradually able to return to normal activity. However, following the persistent back pain that our client has been suffering from, he has subsequently had to finish work completely.
Following negotiations Irwin Mitchell was able to secure £2,154.50 in compensation for our client.
