A woman was walking along the pavement and suddenly tripped over the tines of a fork lift truck. The cab of the fork lift was well hidden by a wall and the tines were raised. The woman was unable to see them as they were the same colour as the road.
The woman severely sprained her ankle and required the aid of crutches for walking. Although the woman took Ibuprofen four times daily the pain seemed to worsen, especially when she was walking or standing for long periods of time. The woman was unable to wear high heels for two months following the accident and the enjoyment of a pre-booked holiday was affected.
The Defendant initially disputed liability, however after a Court appeal the woman received £3,900 in compensation in October 2011.
