A Sheffield man has received compensation after he was injured in a cycling accident that was not his fault.
In May 2009, Mr X was cycling along Hemsworth Road, Sheffield. As Mr X was cycling along he hit a ridge of tarmac and was thrown off his cycle. Mr X suffered injuries to his knee in the accident.
Irwin Mitchell made a claim against the council on Mr X’s behalf for failing to maintain and repair the area. The road surface was dangerous to cyclists and it was alleged that the council failed under their breach of statutory duty under Section 41 of the Highways Act 1980 to repair and maintain the highway.
The council admitted liability and Mr X recovered just over £3,500 in an out of court settlement.
