Our client was diagnosed with mesothelioma in 2006 and sadly passed away one year later. He was exposed to asbestos during the course of his employment.
He worked as a technical officer at ICI Ardeer in Ayrshire, Scotland. The area in which our client worked was surrounded by pipes and vessels that were lagged with asbestos. He was present when the plant and equipment at ICI Ardeer was modernised. This included being present when asbestos lagging was disturbed during the removal of the old plant and also when the new pipework was lagged with asbestos.
Our client was not provided with any breathing equipment.
As our client was exposed to asbestos in Scotland, but lived in England, there was a choice of venue for starting the Court process. As it was more advantageous for the family, the claim was brought in Scotland. This meant that not only the widow, but also other members of the family could be entitled to compensation.
The claim was successfully negotiated out of court settlement obtaining £195,000 compensation for the widow and also £12,000 for each of the 3 adult children and £5,000 for each of the 5 grandchildren of our client.
