The Glasgow Personal Injury team represented a man who was injured in a road traffic collision when he was riding a bike.
In March 2006 Sydney Hewett was riding his bike along a road in Lossiemouth, Scotland. He was in the left hand lane as he approached a roundabout. A car collided with Mr Hewett’s back wheel knocking him to the ground.
Fortunately Mr Hewett was wearing a cycling helmet or he could have suffered more extensive injuries. He suffered a shoulder injury and continues to suffer with this. He also had bruised ribs, injured his abdomen and his left thumb.
The insurance company representing the car driver did not settle Mr Hewett’s case despite negotiation. The personal injury team in Glasgow had to raise a court action in order to get Mr Hewett a settlement.
Mr Hewett received £9,500 in compensation.
Elaine Russell, a partner in our Glasgow personal injury team said: “This was a straightforward accident where fault should have been straightforward and the case should have been settled quickly. However this was not the case and it was necessary for us to litigate in order to get compensation for Mr Hewett.
"I am glad that settlement was achieved for the client but it was disappointing that the insurance company chose to take so long to settle this given the fact their driver had run into our client."
