The woman was walking along a pavement when she was hit by the vehicle which mounted the kerb. As a consequence of the accident she sustained a traumatic brain injury, injuries to her eyes and fractures to her spine.
Our client’s brain injury resulted in her suffering from difficulties with memory, planning and organisation. She also experienced verbal aggression and occasional physical aggression, visual difficulties, sleep disturbance, fatigue, balance problems, neck and back pain plus alcohol use.
The woman came to Irwin Mitchell for help and Leeds-based serious injury solicitor, Carolyn Heaton, managed to secure crucial early compensation payments for the client. The driver accepted responsibility for the accident and interim payments were obtained to fund therapy, case management and support worker input for the woman, who also agreed to engage in an alcohol treatment programme.
The case later settled for a lump sum in excess of £1 million.
