Irwin Mitchell’s Serious Injury team helped a retired man after he lost his wife and sustained severe injuries in a road traffic collision.
Our client was driving his car, with his wife sat next to him in the passenger seat, when a vehicle travelling in the opposite direction crossed onto the wrong side of the road. The retired gentleman couldn’t avoid the oncoming car and the vehicles collided.
The man suffered a number of orthopaedic injuries including pelvic fractures to both of his legs which required surgery. Our client had to stay in hospital for more than four months and underwent a course of physiotherapy. Furthermore, as a result of his injuries, he had to undergo a hip replacement.
Our client struggled to come to terms with the loss of his wife and her companionship. He developed residual symptoms which meant our client often had difficulty doing some jobs around the home and could no longer look after his garden. He was also unable to return to his favourite pastime of cycling and didn’t return to driving.
The driver’s insurers accepted responsibility for the accident and our serious injury specialists were able to secure an interim payment which enabled our client to employ a gardener and cleaner to complete tasks he struggled with or could no longer do.
We also pursed a claim on behalf of his wife’s estate which allowed us to recover costs associated with her funeral.
