Workplace accident experts at Irwin Mitchell have secured a five figure settlement for a woman who suffered soft tissue injuries at work.
Our client was involved in an accident at work in July 2010. She was employed as an assistant manager and was in the process of unloading a lorry which had arrived at her company’s premises from their warehouse. There was a cage within the lorry containing metal shelving and a tore full of metal brackets of which she was unaware.
The cage was positioned so that she couldn’t push it onto the dock-leveller as she’d normally do. Instead she had to pull the cage to remove it from the lorry. As she did so, a tote fell off the cage hitting her ankle, causing her to fall to the ground and sustain injury.
Our client suffered a number of soft tissue injuries including right shin bruising, right ankle pain and left knee pain. She required care and assistance for two months, requiring help from a cleaning company as well as her children.
Prior to her accident our client used to enjoy walking her dog and going for walks with her friends, but she had to stop these activities because of ongoing problems with her right leg. She also felt embarrassed when wearing skirts and altered her wardrobe accordingly.
She was initially off work for three weeks, subsequently returning with the use of crutches for several weeks. She underwent physiotherapy treatment for over three months.
Personal injury expert Katy Bailey acted for our client, recovering £13,000 in an out of court settlement.
Katy said: "Employers have a duty of care to ensure that the workplace is a safe environment. When employees aren’t given the proper guidance or assistance, there can be serious repercussions, as was the case with our client. We hope that lessons can be learnt from this case."
