Malcolm, a lorry driver from Burnley, received a six figure sum in compensation following an accident where he was crushed by an unstable load falling from a lorry. The incident was devastating for Malcolm as he broke both his legs, suffered a fractured pelvis, a broken collar bone, broken ribs and a perforated lung.
This accident left Malcolm unable to work and incapable of enjoying his previous hobby of keeping fit. Irwin Mitchell were able to secure interim payments for Malcolm which helped to keep him and his family afloat financially during this difficult time. We were also able to get funding for psychological therapy for Malcolm, who suffered depression as a result of the accident and his enforced absence from work.
Those responsible for the loading of the lorry admitted liability but it was alleged that Malcolm had contributed to his accident. Lisa Fairclough of Irwin Mitchell’s specialist Serious Injury team reached an out of court settlement on a 95% liability basis in favour of Malcolm.
She said of the case: “This incident shows how important it is for employees to follow the correct method of working as prescribed by their employers. The individual that was loading the pallets onto Malcolm’s lorry was not following the correct loading procedure and his dangerous work methods had life-changing consequences for Malcolm. The employer has now refreshed the training given to their workers, which will hopefully help avoid such accidents in the future.”
