Our Birmingham serious injury team has reached an out of court settlement of £600,000 for a client who suffered serious head injuries when he was run over on a zebra crossing.
The incident happened close to our client's home in Wiltshire. He had just popped out on a short errand and was using the zebra crossing. As he was halfway across the road he was struck by a car.
The driver of the car hadn’t been paying proper attention to the road and was ultimately convicted of an offence as a result.
Our client unfortunately suffered very serious head injuries. Initially there were concerns that he wouldn’t survive. Thankfully, despite the poor early prognosis, he went on to make a better than expected recovery.
Stephen Nye, Partner and head of the Birmingham team dealt with the case. Commenting on the case, he said: "My client sustained life threatening injuries in this incident, and despite his remarkable recovery, he will continue to have long term problems, making it more difficult for him to work in the future. The settlement will provide financial security for the client and his young family.
“His recovery was helped by us being able to secure access to rehabilitation services and a Case Manager in the course of the case. Also, we obtained interim funds to take the immediate financial pressures off the family.
“This case shows that even momentary lapses of attention by drivers can have very serious consequences. No adequate explanation was ever given by the driver as to why she was distracted.
“Drivers must resist the urge to divert their attention from the road to things such as mobile phones and music systems. The Courts will take a very serious view of drivers who act in this way."
