Irwin Mitchell’s specialised road traffic accident team has helped Claire from Banbury to receive compensation after being involved in a head on collision with another vehicle.
Background
On 4 October 2012, Claire was proceeding along an A road in Oxfordshire, when a vehicle that was travelling on the wrong side of the road collided with her head on.
Claire felt pain immediately after the crash and could not exit her vehicle without assistance from the emergency services. On exiting the vehicle, she was examined by a paramedic who sent her home.
Unfortunately Claire sustained multiple injuries to her neck, shoulders, legs and back. In addition, she also suffered from psychological trauma as a result of the incident.
Due to nature of her injuries, Claire visited her GP the day after the accident and was prescribed co-codamol for a period of 2 weeks. In this time, Claire needed help to move around the home and found it very difficult to do daily tasks such as cooking and cleaning. She also had to take two weeks off work but was paid in full during this period.
Along with the injuries that Claire had to cope with after the crash, she also had to deal with the legal and financial aspects associated with a car accident. For instance Claire lost the motor warranty on her new car which was valued at £224, she also had to pay £100 excess on her car insurance, £15.30 for prescriptions and she also lost £52 on fuel and road tax.
How Irwin Mitchell Helped
After contacting her insurer, Claire approached Irwin Mitchell’s team of highly experienced personal injury solicitors to help process her claim for damages and compensation. Irwin Mitchell arranged an independent medical examination which confirmed that Claire had sustained a number of soft tissue injuries to her neck, back and shoulders, bruising to her legs and psychological trauma and would take around two to three months to make a full recovery.
When Irwin Mitchell contacted the insurer of driver that caused the accident they refused to admit that the driver was to blame for the accident. Irwin Mitchell had to then take the matter to court where the insurer disputed the claims made by Claire.
Irwin Mitchell were able to prove that Claire was not responsible for the accident and secured a settlement fee of £3,000.
The offer was accepted which meant that Claire received £500 to cover her finances, and £2,500 for her injuries.
