Lawyers from Irwin Mitchell’s Leeds office have helped a man recover compensation, after his previous solicitors failed to advise him correctly in relation to an assault.
Our client was attacked in 2002, leaving him with a serious head injury. He contacted a firm of solicitors and was awarded £100,000 after a claim through the Criminal Injuries Compensation Authority.
The man’s injuries had caused him to lose his job and he was entitled to means tested benefits. When his case settled, the law firm advised our client to seek financial advice. The man wasn’t told why this was necessary, nor was he told that the settlement would affect his entitlement to benefits. The firm also failed to advise the injured man that he could set up a special needs trust that would protect his benefits position.
This failure to provide the necessary information meant that our client lost his entitlement to have his mortgage interest paid. He was forced to use his compensation settlement to pay off his mortgage.
