Irwin Mitchell’s specialised accidents at work team have secured £115,000 in compensation for a Polish factory worker who suffered severe hand injuries while working at Cranswick County Food.
Krzysztof Duda, who was 37 years old at the time of his injury, was operating a band saw to cut through meat carcasses when his hand was snatched towards the blade. He suffered severe hand injuries which required his left ring finger to be amputated and many hours of complex surgery to save his thumb.
Mr Duda contacted Irwin Mitchell’s accidents at work team and one of our experienced solicitors dealt with his claim. We argued that the company operated an unsafe system of work and had breached many health and safety laws. Shortly before Mr Duda’s injury, the company had faced two prosecutions for serious injuries caused to workers using cutting machinery.
Ian Bailey, a Partner and head of workplace injuries at the Leeds office of Irwin Mitchell said: “It is astonishing that the Health & Safety Executive failed to prosecute in this case where I believe there was a clear breach of the regulations where my client was operating highly dangerous machinery for 12 hours a day with just a few minutes break.
“The surgeons have done a tremendous job to salvage any use in Krzysztof’s hand but he has been left significantly disfigured and will always experience reduced grip strength and have difficulty when lifting heavy items. This will clearly affect his long term employability. The financial settlement he has received should help with the future loss of income.”
Speaking through an interpreter, Mr Duda said that he wished to express his thanks for the work the surgeons had done in Hull and he was pleased that the company, through the payment of damages, had accepted its responsibility for causing his injuries.
