Our specialist asbestos related diseases team has secured compensation of over £100,000 for one of our clients, Mr T, 67, who had been exposed to asbestos as a young apprentice with William Kendrick & Sons Limited.
Exposure to Asbestos
Mr T was based at the company premises in Tasker Street, Walsall. He worked across the West Midlands region during his eight years of employment, including a number of schools, industrial plants, factories and public buildings.
Some of the schools included Francis Martin Secondary Modern Catholic School in Walsall and Frank F Harrison School in Beechdale, where Mr T would cut, prepare and fix asbestos to the building. Despite the risks to his health, Mr T was never made aware of the dangers by his employer, or given a protective mask to wear.
Diagnosis of Mesothelioma
Unfortunately, Mr T was diagnosed with the asbestos related disease, mesothelioma, later on in life. At the time he was diagnosed, he had been enjoying his retirement having worked hard his entire life. He had many interests including marshalling, gardening and attending his local gym five days a week.
Battle for Justice & Final Settlement
Court proceedings were started by Irwin Mitchell against Mr T’s past employer at the Royal Courts of Justice. Judgment was entered and the judge ruled that William Kendrick & Sons Limited had been negligent and ordered them to pay an advance payment of £50,000 in compensation. The matter was successfully settled soon after for damages in excess of £100,000.

No regard was given for the welfare of carpenters such as Mr T who would spend hours being exposed to the asbestos dust and fibres on a daily basis without suitable protection to which he was entitled.
