An Irwin Mitchell client has received damages in excess of £350,000 following injuries sustained in an accident at work.
The injuries were suffered when a metal girder fell, striking our client on his head and shoulder. It fell because a fellow employee had decided to try and move it, whilst our client was working below.
The employee had failed to give any warning of what was about to do and failed to consider the safety of our client.
Multiple injuries were sustained including a fractured skull, a fractured vertebra and soft tissue damage.
Our client was taken from his place of work by ambulance and was initially immobilised due to his spinal fracture.
The employer admitted liability and attempted to partially blame our client for what happened. We resisted these allegations and full compensation was recovered.
Stephen Nye, Partner in our Birmingham Serious Injury team pursued the case.
He said “This was an incident which was entirely avoidable. A moment of carelessness by one employee has had drastic consequences for my client. If the employer had planned the work properly and considered the risks involved, then I am sure this incident would have been prevented.
My client has suffered terribly from his injuries and continues to contend with pain and limited mobility. The damages recovered will replace his past and future loss of income given that his ability to work is now severely compromised."
