Mr D of Willenhall, West Midlands has secured compensation from his employer for an injury sustained during his employment late last year.
On the day of the accident, Mr D was working in the warehouse yard and was operating a machine that enabled him to load pallets onto a lorry.
Mr D was standing on the platform where the machine is operated from, with the pallets loaded onto the forks of the machine. He then drove the machine towards the lorry to load the pallets, in doing so, the machine hit a raised steel lip between the loading dock and the plate of the lorry. This caused the machine to stop dead, throwing Mr D from the platform to the warehouse floor.
As a result of the accident Mr D suffered injuries to his elbow and back which prevented him from working and severely impeded his daily life. He was unable to care for himself for a month following the accident.
Through the hard work of specialist personal injury lawyer Reiss Matthews of Irwin Mitchell’s Birmingham office, Mr D was awarded compensation for his injuries. He has since recovered and retuned to work.
Reiss Matthews commented:
"We understand that the defect in the warehouse yard had been present for a number of years and had been discussed on several occasions at the monthly safety meeting. Despite such discussions, his employer did nothing about the state of the yard.
“We are pleased that we were able to obtain compensation on behalf of our client but at the same time this accident should have been prevented and shows how vulnerable employees are when their employer disregards their health and safety."
