Caroline Stokes and Jhodi Ward, specialists in medical negligence and patients’ rights at Irwin Mitchell, have successfully secured compensation on behalf of a man who received a misdiagnosis of epilepsy which drastically affected his life throughout childhood and into early adulthood.
Our client was diagnosed with epilepsy when he was four years old after suffering from dizzy spells and episodes similar to fainting. These were mostly triggered by pain. Following the diagnosis, he was put on medication straight away which increased in quantity and strength as he got older.
To confirm the condition, he was given two ECG’s and a brain scan as well as six monthly check ups at the hospital. During this time, he still had the episodes.
After one particular episode, our client was told that he had very low blood pressure, he received a letter from a neurologist to come in to the hospital and investigate it further. The neurologist thought that our client may have been misdiagnosed with the condition and further tests proved that this was the case.
Low blood pressure was causing him to faint and have the dizzy spells, not epilepsy. This misdiagnosis severely affected our client for many years, he was unable to partake in sports or learn to drive.
Caroline Stokes and Jhodi Ward, experts in clinical negligence claims, investigated the case and agreed a settlement of £110,000 with the negligent Trust. It was decided that this misdiagnosis of epilepsy was negligent and if it hadn’t occurred, out client’s life would have been significantly different.
