Specialist lawyers from our workplace illness team have successfully claimed £117,149.95 in compensation for a 67 year old grandfather who sadly died from an asbestos related cancer called mesothelioma.
Mr M had been working for JWR Coventry Limited for over 30 years, where he was repeatedly exposed to asbestos based products, some of which he could not avoid inhaling. His role included removing old heating systems that had traces of asbestos in them, refurbishing work within schools and transporting other products in a lorry that contained asbestos.
During this time he did not receive any health or safety training about the dangers of asbestos exposure and the deteriorating effects it can have.
Before Mr M was diagnosed with mesothelioma he was very fit and healthy. It was around Christmas time in 2008 when our client visited his GP complaining of chest and shoulder pains. He was referred to hospital where he had various tests including chest x-rays, CT scans and a biopsy. The results came back and Mr M was diagnosed with mesothelioma in January 2009. Although Mr M had an operation and chemotherapy throughout the start of the year, he sadly passed away in August 2009.
It was a while after Mr M’s death that Irwin Mitchell were contacted by his family. Hayley Hill, Associate and Workplace Illness specialist from the Birmingham office took on the case. Hayley said:
“This was a difficult claim as we were asked to help after Mr M died and therefore did not have any direct evidence from him as to the nature of his exposure to asbestos during his employment. We carried out in depth investigations on behalf of Mr M and his family which secured sufficient evidence to get his employer to agree that Mr M had been wrongly exposed to asbestos during his time at JWR Coventry Limited. Although the compensation will not bring back their loved one, we were extremely pleased to be able to successfully conclude the claim and to provide some security for Mr M’s wife and family following his tragic premature death from this work related illness.”
