Through the hard work of specialist solicitors at Irwin Mitchell’s London office, a woman who sustained significant injuries after being involved in a head-on collision has been awarded £123,000 in compensation.
On 24 January 2011, our client was on her way home when suddenly another vehicle veered into her land on traffic, causing a head-on collision. Due to the force of the impact and damage caused, our client had to be cut of her vehicle by the emergency services.
Background Of Injuries
Our client suffered from multiple injuries, which included fractures to the right ulnar and radius, injury to a ligament in her left knee, general bruising and a minor head injury which has since led to a psychiatric injury (adjustment disorder with travel anxiety).
Previous solicitors had been instructed by the client, however during this time she had not benefited from any rehabilitation and liability was still in dispute despite the Defendant’s criminal conviction.
In early 2012, she instructed Irwin Mitchell to take over her case and within 18 months full liability was received, along with interim payments and final settlement of the case.
Interim Payments Received
Irwin Mitchell ensured that interim payments were made to fund our client’s rehabilitation. This allowed her to have access to a pain clinic and specialist treatment to help her travel anxiety and low mood. The interim payments allowed for her to have domestic help in the form of cleaners as her fractures prevented her from doing domestic chores.
During this time, extensive investigations were carried out to highlight the difficulties our client experienced as a result of her injuries, both in relation to caring for her disabled daughter and also managing the running of her household. Evidence was also received from a medical expert, which supported the need for rehabilitation to maximise the opportunities of her making a full recovery.
Compensation Secured
The Defendant’s solicitors made an offer of £65,000 in full and final settlement of the claim. With the specialist advice of Irwin Mitchell solicitors, they were able to identify very easily that this was not a sufficient sum and issued Court proceedings. Further negotiations took place and the case was finally settled with our client securing £123,000 in compensation.
The compensation secured will allow our client to have access to the rehabilitation she needs so she can look forward and hopefully make a full recovery. It was also allow her to access specialist treatment, pain clinic and domestic assistance and all the other recommendations put forward by her case manager.
