Irwin Mitchell’s specialist Personal Injury team has helped an elderly gentleman claim compensation after he was involved in an accident at his home, which is owned by the local Council.
Our client, who was from Newport, was returning home after visiting the local shops. As he descended a flight of concrete steps leading down to his front door, he fell forwards hitting his head against his front door. Our client sustained severe bruising around both eyes, injury to his neck, as well as a deep cut to his head which required eight stitches.
He decided to contact our specialist Personal Injury team and Laura McCleary of Irwin Mitchell’s Fast Track Personal Injury team, based in Birmingham, was able to deal with his claim. Initially, the Council denied responsibility for the accident, but after some lengthy negotiations, she was able to secure £5,000 in compensation for the gentleman's injuries.
Laura said: "The Council had been aware that the concrete steps were defective prior to my client’s accident. There were records that a job had been inputted on their repairs system prior to the accident, but this had been cancelled.
"Had the Council repaired the steps in a reasonable time frame, my client’s accident could have been avoided. The defendant company failed to discharge the duty of care they owed to my client and allowed a foreseeable danger to remain."
