A Birmingham man has successfully recovered compensation of nearly £15,000 following an accident at work.
Our client was injured in the course of lifting a heavy heating unit whilst refurbishing some office premises.
The heavy unit was being lifted with the assistance of colleagues, but the task had not been properly considered in advance and an unsafe method of work was adopted.
Stephen Nye, works accident specialist in our Birmingham office dealt with the case. He commented: "My client suffered very painful injuries to his back, though thankfully he made a very good recovery. This could have been a far more serious incident. The work system that had been adopted was clearly dangerous and was an accident waiting to happen. My client had initially thought he would not be able to pursue a claim, as the company he had been working for at the time had gone into liquidation. However, as the company did have insurance at the time of the accident, we were able to apply to restore the company to the register and proceed with the claim. This case shows the importance of employers complying with their obligations to have liability insurance in place. The absence of such insurance means employees injured through no fault of their own would not be compensated".
