A mother in Leeds has received £11,000 in compensation after witnessing the tragic death of her four year old son who was sadly knocked down outside the family home. The mother witnessed these horrifying events and rushed immediately to her son’s assistance but he had sustained catastrophic head and chest injuries and died shortly after the accident.
With the help of Cathryn Godfrey in the Serious Injury team at Irwin Mitchell Solicitors, the mother brought a claim against the driver of the vehicle for the psychological injury sustained after witnessing the accident. A separate claim was brought on behalf of her son’s estate, which settled for nearly £13,000. This consisted of bereavement damages for the family and compensation for the funeral expenses incurred.
Cathryn said: "This was an extremely sad set of circumstances for all family members involved. The compensation received will not compensate for the tragic death of this little boy but will hopefully assist his mother in receiving treatment which may assist her in coming to terms with the accident. The claim on behalf of her son’s estate included the statutory award which is made following the death of a child in these circumstances".
