Irwin Mitchell’s specialist serious injury team in Birmingham has secured a settlement of £8 million for a Midlands man who sustained a devastating brain injury in a road accident.
Our client sustained his injury when his car was struck head on by a lorry which had attempted to take a corner at too high a speed.
His injuries were so severe that he required inpatient treatment and rehabilitation for nearly 18 months. Subsequent to this we were able to secure very substantial interim payments for him which allowed for the introduction of a comprehensive care, case management and therapy package.
Stephen Nye, Partner in our Birmingham office headed the legal team. He comments: "This case involved injuries of the utmost severity. Our client had complex needs and we were able to use the legal process to secure funds to ensure that those needs were met as the case progressed. The case was fiercely contested throughout, but we were successful in securing funds for care, therapy and the purchase of a suitable home.
The final award of damages will be managed through the Court of Protection, as our client's injuries mean he cannot manage his own affairs. The terms of settlement include a guaranteed annual payment for life to cover his substantial care needs. This will provide absolute security for his future care provision.”
