Our client and her husband were out seeing friends for dinner. After the meal they returned to their vehicle and crossed a road, at which point they were hit by a van. The woman sustained serious orthopaedic injuries as a result of the collision, whilst her husband sadly sustained fatal injuries.
Irwin Mitchell were instructed on this case in order to gain justice for our client for what she had suffered, both through the loss of her husband and the injuries sustained. Liability was strongly disputed in this case with the Defendant making no offer as to either liability or quantum. This continued up to the point of a Joint Settlement Meeting (JSM), which took place one month prior to the liability trial. Irwin Mitchell attended the Inquest and with representation by Counsel, we were able to secure a finding of unlawful killing for the family.
Further, at the JSM, in light of our expert evidence, we were able to settle both the claim on behalf of our client and on behalf of the estate for nearly £300,000 on a 100% liability basis.
