A hospital employee has received £75,000 in compensation after sustaining a
back injury when the stool he was sitting on whilst treating a patient suddenly collapsed beneath him. The mechanism that should have held the stool at the chosen height had failed.
It was claimed that the accident had brought forward back symptoms that the employee would have gone on to develop in the future. He suffered ongoing pain and also suffered a negative psychological reaction to the limitations placed upon him by his injuries.
The employee was unable to work for almost two years after the accident but was eventually able to find an alternate role which accommodated his restrictions.
Compensation was awarded for lost earnings that the employee had suffered.
This should serve to remind businesses that it is essential to maintain the equipment that they provide to their staff to ensure that it is kept in a good state of repair.
