Our client, 23 year old Ian Stych, has successfully pursued a case which will mean that he will now be entitled to compensation in respect of his devastating injuries.
Ian sustained a spinal cord injury in a road accident , when the vehicle in which he was travelling overturned close to his home. He has been left tetraplegic and will be a wheelchair user for life, with round the clock requirements for his care.
A trial took place at the Birmingham High Court in April. Whilst the driver of the vehicle had admitted he was at fault, the insurers of the vehicle denied that they had any liability to compensate our client.
This denial was based upon their argument that Ian knew or should have known that the driver had taken the vehicle unlawfully. Ian categorically denied this.
Stephen Nye, Partner at our Birmingham office dealt with the case and commented, " We are delighted to have won this case for Ian. He has been catastrophically injured through no fault of his own, but has had to fight to establish his right to compensation.
The Judge found that he had been entirely truthful in his evidence and that he did not know that the driver had taken the vehicle without permission.
Ian's injuries are extremely severe, but it is hoped that now this battle has been won, his circumstances can be improved by accessing interim funds and addressing issues such as more suitable accommodation, further therapy and further rehabilitation".
