Irwin Mitchell's specialist serious injury team has helped a widower to claim compensation, after he tragically lost his wife as a result of a head on collision with an under the influence and uninsured driver.
'L' was travelling as a passenger in a vehicle with her best friend. They were driving home after an evening meal. The defendant, who was under the influence of drink and drugs and driving a stolen vehicle without insurance or a licence, was driving at speed on the wrong side of the road and collided head on with their vehicle. L and her friend tragically died at the scene of the accident.
The defendant was subsequently convicted of two counts of death by dangerous driving and two counts of aggravated taking without consent, in addition to four other offences and is now serving 12 years imprisonment.
With the help of Cathryn Godfrey of the Leeds Serious Injury team at Irwin Mitchell Solicitors, L’s husband brought a claim on behalf of himself and their two children for the accident. This comprised of bereavement damages, the loss of a wife and mother’s love and affection, funeral expenses and a dependency claim for the loss of income and care and assistance provided by L.
Cathryn said: “This was a tragic case. The money secured through the claim will assist the family as they work to rebuild their lives, without their wife and mother”.
