Our client slipped on a puddle of water whilst visiting a shopping centre in Grimsby, South Humberside and has been awarded £2,675 in compensation.
Sarah visited the shopping centre in Grimsby on 6 October 2009. As she walked through the shopping complex, she suddenly slipped on a puddle of water on the floor and fell backwards, hitting the floor. The accident was officially reported to the shopping complex.
Following the accident, Sarah saw her GP because she was suffering with neck pain and a lower back injury.
Sarah instructed Irwin Mitchell Solicitors to investigate the claim against the shopping complex, who denied liability. They did, however, allege that their cleaning contractors were responsible for checking and cleaning the centre even though they too denied responsibility.
We were finally able to help Sarah reach a settlement against the cleaning company after an independent witness statement was obtained and the cleaning company made an offer of compensation.
Following the accident Sarah has made a good recovery.
Katrina Elsey from our Public Liability Team dealt with Sarah’s case said “In this case the cleaning contractors failed to enforce an adequate system of cleaning and inspection of the shopping complex but instead left the water unattended upon the floor which resulted in our client’s accident. Had a proper inspection and cleaning regime been implemented than the accident could have been avoided.”
