Irwin Mitchell has successfully represented the widow of a lady who sadly died as a result of negligent spinal surgery on a prolapsed disc which led to the death of his partner.
Ms Burgess was taken to the Accident & Emergency Department of her local hospital in May 2006 after suffering with severe back pain for some months. As a result of the pain Ms Burgess had numbness in her left leg and had difficulty controlling the passing of urine.
When Ms Burgess was admitted to hospital she had an MRI scan which revealed that she was suffering from a prolapsed disc. 2 days later Ms Burgess underwent routine spinal surgery at Hope Hospital. Sadly, the operation was performed negligently, and resulted in fatal damage to Ms Burgess’s heart. The operating staff tried to resuscitate her but she sadly passed away shortly after the operation.
Ms Burgess's partner instructed Irwin Mitchell to investigate a claim on behalf of Ms Burgess’s Estate and on his own behalf. The case against the Hospital Trust was settled in Court for an undisclosed sum.
