Our client sustained soft tissue injuries to his neck and spine when he was involved in a high speed collision.
He was stationary in a queue of traffic, when he was struck from behind by a lorry. The driver of the lorry had not been paying proper attention to the road.
Despite early hope of a full recovery, our client developed a serious chronic pain problem in his spine, which was caused by damage to his nerves from the accident.
Despite attempts at treatment and rehabilitation, the condition did not improve significantly and will be a lifelong problem.
Stephen Nye, Partner in the Birmingham Serious Injury team dealt with the case and commented:
"This was a complex case in which the initial external injuries appeared to be relatively minor, but which developed into a complex, persistent pain state. My client tried every possible avenue to try and improve his pain problem , but unfortunately little improvement occurred. As a result he will have to contend with the problem for the rest of his life and his ability to work and live an active life will be more limited.
“The settlement reached provides for the future losses he will sustain and also some further treatment to help him cope.
“This was a difficult case, as the paying insurer refused to accept the validity of the client's symptoms, though by securing high quality expert evidence we were able to establish that the condition was entirely genuine, that then being reflected in the settlement".
