Irwin Mitchell recently assisted a 49 year old Devon woman with a compensation claim following an accident at work which left her with torn shoulder tendons and requiring surgery.
The accident occurred when the client was asked to load boxes onto a truck at work, however the truck she had been instructed to work on was a replacement, not designed for the conveyor belt that fed the parcels to her. As a result, she was required to lift parcels weighing 25kg and more from knee level to above shoulder height continuously, until her truck was loaded.
The delivery company, accepting liability for providing an unsafe system of work and unsafe work equipment, agreed damages of £8,500 in an out of court settlement for the client as compensation for the pain and suffering that was caused as a result of the injury sustained.
