We were instructed by Mr F, aged 80, in October 2010. A settlement in the sum of £144,500 has been recovered from his former employer, Birmingham Railway Carriage & Wagon Company Limited.
Mr F was diagnosed with asbestos related mesothelioma in September 2010 following exposure to asbestos while preparing railway carriages at the factory premises situated at Middlemore Road Smethwick West Midlands where he worked.
Our client began feeling unwell in January 2010 with symptoms of breathlessness. Having retired in 1993 Mr F enjoyed spending time with his family and had previously had good health enjoying playing golf three times a week. He was referred by his GP to hospital and was admitted for tests. He was told after a biopsy, in September 2010, that he had mesothelioma and approached Irwin Mitchell to represent him in a claim against his former employer.
A letter of claim was sent on our client's behalf followed soon after by the commencement of Court proceedings under the court’s expedited process for mesothelioma cases. A voluntary interim payment of £50,000 was obtained on our client's behalf, 8 months after he was diagnosed. The court entered judgment for our client and settlement of the claim was successfully achieved in July 2011.
