Our client was diagnosed with a left inguinal hernia and underwent a hernia repair at the Torbay Hospital on 12 June 2009.
He remained in hospital overnight due to pain and was discharged the following day. The GP was contacted and analgesia was prescribed due to continuing pain and then on 16 June 2009 it was noted he had swollen testicles.
On 18 June 2009 he attended the Accident and Emergency Department and an ultrasound scan confirmed he had a "left testis heterogeneous echogencity – testicular ischemia". He was referred to a Surgeon and underwent a removal of his left testes on 19 June 2009.
There were some post operative problems with swelling, discomfort and a haematoma.
A offer of £3,000 was made by the defendant, in full and final settlement in March 2010.
