£27,500 Following Cycling Accident
A young Coventry man has reached an out of Court settlement of £27,500 following a cycling accident in a local park.
He sustained serious facial injuries when, as he was riding along a cycle path, he collided with a long section of fencing which had collapsed across the cycle-way. The accident happened at twilight, so he did not see the fence lying across the path until it was too late. He was thrown from his bicycle and sustained facial and dental injuries.
Stephen Nye of our Birmingham office conducted the claim and comments, "The case was brought against the landowner who was responsible for the fencing. In allowing the fence to fall into disrepair and collapse across the cycle-path, they had breached their duty as occupier of the land and were also creating a public nuisance. The settlement came after proceedings were issued in the face of a denial of liability. The funds will enable my client to access the dental treatment he requires following his injuries."
