Jonathan Preston, an associate solicitor in our Commercial Litigation team, recently acted on behalf of a leading international energy company in a dispute with a global communications company. The dispute related to an alleged breach of contract on the part of Jonathan’s client. There were other complicating legal issues which included jurisdiction, novation and causation of loss.
Jonathan’s client was being sued at court for damages for alleged breach of contract; the opposing company alleged that both parties were bound by a contract until the end of 2008. The opponent claimed a six figure sum. Jonathan’s client disputed liability for numerous reasons including the very absence a contractual obligation on its part. However, it was a risky case hinging on matters of evidence as well as law.
Jonathan assisted his client in putting forward the client’s position and then subsequently achieved a very favourable settlement for his client. In addition to resolving the dispute without the court having to determine the case, the settlement agreement should enable the parties to maintain their commercial relationship.
